You agree to abide by all copyright notices, information and restrictions contained in any content on the Site. SSRC reserves the right to take legal action against any unauthorized use of the information, data, images, videos, trademarks and other material of SSRC found on the Site.

Certain features or services offered on or through the Site may require you to open an account (including setting up a Steamboat ID and password). You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You agree to notify SSRC immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by Steamboat or any other user of or visitor to the Site due to someone else using your Steamboat ID, password or account as a result of your failing to keep your account information secure and confidential.

You may not use anyone else’s Steamboat ID, password or account at any time without the express permission and consent of the holder of that Steamboat ID, password or account. SSRC cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Disclaimer and Limitation of Liability

To the fullest extent permitted by law, SSRC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The Site is provided “as is” and “with all faults.” Such faults include typographical misprints that may occasionally result due to human error. Should any content prove defective, you, and NOT SSRC, shall bear the entire cost of all necessary servicing and repair.

Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflicts of laws principles, and exclusive jurisdiction over any proceedings arising from or related to this Agreement, or the activities and events contemplated hereby, shall reside in the Courts of Routt County, Colorado or the United States District Courts for the District of Colorado. You hereby consent and submit to the jurisdiction of such courts for the purposes of litigating any claim.

Severability

If any clause or provision of this agreement shall be held to be invalid in whole or in part, then the remaining clauses and provisions thereof, shall nevertheless be and remain in full force and effect.
